Godley IGH Terms and Conditions

Definition

In these Conditions "the Company" means the company issuing the quotation or acceptance of Order or invoice or otherwise assuming the obligation of seller under any contract to which these conditions apply. "Goods" refer to the products the customer is offered requested or has purchased through Godley International Gold House.

General

1. All information supplied on registration must be fully correct at the time of application and absolutely all changes must be reported to the company immediately.

2. The company reserves the right to refuse application for registration at the company's absolute discretion.

3. The company reserves the right to alter any of the terms and conditions with out prior notice, informing the customer of such changes immediately.

4. Except for small orders, unless otherwise agreed in writing, there will be no variation to the terms and conditions as stated here.

Transactions Must be Confirmed

No order for the purchase or sale of Metals or Coins shall be binding upon Godley IGH unless and until the Transaction is confirmed by Godley IGH with a trade number given to Client. Godley IGH, in its sole discretion, may discontinue accepting orders for the purchase of any Metals or Coins or alter or terminate its repurchase policy at any time without advance notice.


Client Bears Market Risk After Purchase; General Risks Associated with Metals and Coins

Once a transaction is confirmed by Godley IGH, a contract is created. Regardless of what happens to the price of the Metals or Coins after the Transaction is confirmed, the contracted price is binding on Client and Godley IGH. Client bears the full risk of any movement in the market price of the Metals or Coins between the time of purchase and subsequent delivery. Except as otherwise expressly provided herein, Client is obligated to take delivery of Metals and Coins in consideration of the purchase price originally established in the Transaction, regardless of any subsequent change in the value of the Metals or Coins. Client acknowledges that prices of metals and coins are volatile, and therefore the prices of Metals and Coins may fluctuate significantly over time, based upon numerous factors, including supply and demand among collectors and political and economic conditions.

Payment

1. We accept payment in cleared funds. We accept personal cheques, company cheques, and bank drafts, which we clear, allowing a full working week if drawn on a UK bank. This is our preferred payment method for small payments (under about £10,000). We also accept bank transfers. Our bank details are shown on the About Us page. If you pay by bank transfer, we like to have a written order by conventional mail.

2. We will accept payment in any negotiable currency at our discretion.

3. We normally require security before entering into any contract. This may take the form of a deposit, or full payment. We may at our discretion waive this requirement for small quantities.

4. Clients ordering by post, telephone, internet or other remote methods may wish to use our order forms. If an agreement is made by telephone, we will require the purchaser's name, address, and telephone number at the point of agreement. We then expect a faxed or e-mailed confirmation immediately, confirming that payment has been effected. If the agreement is to post a cheque, then it must be posted by first class post in time to be collected and postmarked the same day, so that it should be received within two working days. The confirmation should include all identification details necessary.

5. For large transactions, where we hold a deposit, cleared funds should reach us within 48 hours.

6. For all purchases, if Godley IGH for any reason fails to receive Client's payment as required herein within two business days of the transaction date, Godley IGH in its discretion may at any time thereafter sell the Metals or Coins covered by the Transaction without further notice to or authorization from Client and hold Client responsible for any losses and costs incurred by Godley IGH as a result. Client agrees immediately upon demand to pay and reimburse Godley IGH for all transaction fees and all losses incurred by Godley IGH as a result of any such payment default by Client and subsequent liquidation of the Metals or Coins involved. This will be taken from any deposit or security.

Delivery

Metals or Coins will usually be shipped to Client within two business days via registered, insured mail, once the final payment in Good Funds has been received and the funds have cleared. Where we have allowed a full week for cheque clearance we may often reduce this period. At times of heavy demand, we may require an extra day for goods delivery. Delays can and do occur in us receiving inward deliveries thus our delivery time to you will not be "of the essence" to the contract. If you need delivery by a particular guaranteed date or time, you must state this before completing an agreement with us, and higher prices and / or stricter payment conditions may, although not usually, apply.

Losses During Shipment; Force Majeure

Godley IGH shall not be responsible for any loss or disappearance of any Metals or Coins while with postal courier or otherwise shipped or delivered in accordance with this contract or with Client's instructions for any Transaction(s). Client shall make claim and have recourse to any postal insurance or other claim against the courier service, and not Godley IGH. Furthermore, in the event of any act of God, transportation or shipping disruption or breakdown, failure of utilities or telecommunications, war, labour unrest, or other event beyond Godley IGH's reasonable control, whether or not similar to the foregoing, the obligations of Godley IGH hereunder shall be suspended to the extent affected thereby and Godley IGH shall have no liability to Client as a result thereof.

Identification and Notification (Except for Export Sales)

We are legally obliged to obtain and retain identification records for every purchaser or seller for a minimum of six years.

Buying and Selling

Although we have referred mainly to customers as buyers, these notes should be understood to apply similarly to customers who are selling to us, in which case we expect shipment to us without delay, and we will make payment by return post.

If Client wishes to sell Metals or Coins or Scrap to Godley IGH, Client may telephone or otherwise contact a Godley IGH marketing representative and advise such representative that Client desires to sell Metals or Coins or Scrap to Godley IGH. If so instructed by Godley IGH representative, Client shall deliver the Metals or Coins or Scrap to be sold, at Client's risk and expense, to offices of Godley IGH. Upon Godley IGH receipt of the Metals or Coins or Scrap, Godley IGH shall verify the quantity and quality of the delivery, usually within one business day, and then telephone or otherwise contact Client to set a purchase price based on the then-current bid price for such Metals or Coins or Scrap. At such time, a Transaction number will be given to Client to confirm the Transaction. No purchase Transaction occurs prior to Godley IGH giving Client a Transaction number. Godley IGH will issue payment for the Transaction to Client within two business days of the Transaction date. In the event that Godley IGH cannot verify the quantity or quality of the Metals or Coins o Scrap, or if Client does not accept Godley IGH's bid price therefore, then the Metals or Coins will be returned by at Client's risk and expense via registered, insured mail.

Patents

To the best of the company's knowledge goods sold to the customer will not infringe any patent, trademark, registered design or copyright of any third party but the company shall in no circumstance be liable to the customer in respect of an such infringement.

Proper Law

All contracts between the company and customer will be deemed to have be entered into at the place of the company's office and shall be governed by English Law.
